Our Warranty
General Information
At Amqua, we take pride in using high-quality materials to ensure our products are not only comfortable and perfectly fitted but also highly durable. However, despite rigorous quality checks and testing, we cannot guarantee that your Amqua bedding will never experience wear and tear. If a product has a material defect, we provide the following manufacturer’s warranty in addition to the legal warranty that consumers are entitled to from the seller under statutory regulations.
Amqua GmbH, Becksfelder Weg 19, 21279 Appel, Germany, grants consumers a limited-time warranty on the products it manufactures under the conditions and scope described below. This manufacturer’s warranty applies without prejudice to mandatory legal liability provisions, such as the Product Liability Act, in cases of intent or gross negligence, as well as harm to life, body, or health caused by Amqua GmbH or its agents.
For the purpose of this manufacturer’s warranty, a consumer is defined as any natural person who owns the product and has not purchased it with the intention of reselling it privately or selling it as part of their commercial or self-employed business activities.
Scope of the Warranty
This warranty applies exclusively within Germany and the European Union and covers all Amqua products purchased from 01.01.2020 onwards (purchase receipt required).
Amqua GmbH guarantees that its products are free from material defects at the time of delivery. Claims based on product liability exist only within the scope of statutory regulations. Under this warranty, defects proven to be caused by a material defect will be addressed.
- Warranty Period: The warranty applies for 24 months from the date of purchase.
- If a product is defective upon delivery (unopened and unused), the issue must be reported to our support team immediately after receiving the goods. We will arrange a replacement shipment.
- Defects that appear after use can be reported via our warranty claim form.
- Products older than 24 months are not covered by this warranty.
If a warranty claim is valid, we will repair or replace the product free of charge. If an identical replacement is unavailable, we may offer a successor model or an alternative color.
If a customer reports an issue with the same product purchased from multiple sales channels (e.g., Amazon and our online store), we will consider this as a single warranty claim, covering only the total number of defective items.
Each product can only be claimed once per order and size.Duplicate warranty claims for the same product in the same order will not be processed. Additionally, claims must include a clear photo showing the defect.
Amqua GmbH reserves the right to offer a partial or full refund instead of a replacement. This warranty is an additional service to statutory consumer rights and does not replace or limit them. It is a voluntary, non-legally binding service that may be denied without reason.
Exclusions from Warranty
The following cases are not covered under this warranty:
1. Courtesy Replacements & Gifts
- If the product was received as a gift or goodwill replacement, the recipient has no warranty claim.
- A valid purchase transaction is required for any warranty claim.
2. Purchases from Third-Party Sellers
- Products bought from unauthorized third-party retailers are not covered.
3. Promotional Free Items
- If a product was received for free as part of a promotional event (e.g., trial campaign), it is not covered.
4. Products Older Than 24 Months
- Items with a purchase date exceeding 6 months are not eligible for warranty claims.
Replacement of a Previously Replaced Product
A warranty claim on a previously replaced item is only valid if the replacement claim is made within 6 months of the original purchase date.
A replacement is only granted if, due to the defect, the customer ends up with fewer functional units than originally purchased. In other words, we will only provide another replacement if the defect results in fewer usable items than initially ordered.
How to Make a Warranty Claim
To submit a warranty claim:
- Send an email to support@amqua.com explaining the case with pictures of defect
- Our support team will guide you through the next steps.
- Returns within Germany are free of charge in case of a valid warranty claim.
Warranty Claims for Gifted Products
If a product was purchased by Customer A and gifted to Customer B, the warranty claim can only be made if Customer B provides all relevant purchase details from Customer A, including:
- Email address
- Order number
- Full name
- Shipping address
These details must remain unchanged and be used exactly as they were in the original purchase for warranty processing.
Documentation Requirement
A warranty claim must include clear photos showing:
1. The Amqua logo
2. The size and color of the product
3. The exact defect
Legal Notice: Warranty Commitment (§ 477 BGB)
This manufacturer’s warranty exists independently from statutory consumer rights and does not affect the buyer’s legal warranty claims under German law. Consumers can still exercise their legal rights for defects, including:
- Repair or replacement
- Refund or price reduction
- Compensation claims
These rights are governed by § 437 BGB and subject to specific statutory limitation periods in § 438 BGB.
Liability & Limitation
This warranty does not cover consequential damages or any other claims for compensation. However, this limitation does not apply where legally required, such as:
- Product liability laws
- Cases of gross negligence or intent
- Harm to life, body, or health caused by Amqua GmbH
Exclusion & Expiration of Warranty Claims
- Warranty claims must be submitted within 2 months of discovering a defect.
- After this period, claims are no longer valid.
- Warranty claims expire 6 months after the warranty period ends.
